Terms of Service

These Terms of Service ("Terms") govern your access to and use of the creative strategy and growth services provided by Lone Peak Arts LLC ("we", "us", or "our"). Please read these Terms carefully before engaging our studio.

1. Scope of Creative Services

Lone Peak Arts LLC agrees to provide the partner with strategic growth services as outlined in a mutually agreed-upon Statement of Work (SOW) or Creative Brief. Services may include, but are not limited to, Search Visibility Mastery, Precision Media Buying, Cultural Engagement, and Creative Storytelling. Specific deliverables and timelines will be detailed in the SOW.

2. Partner Obligations

The partner agrees to provide all necessary intelligence, access to accounts (e.g., website backend, ad platforms), and creative assets required for Lone Peak Arts LLC to perform the services. The partner is responsible for the accuracy and legality of all materials provided. Timely feedback and creative approvals are essential for maintaining project momentum.

3. Investment Terms

Payment for services will be made according to the investment schedule specified in the SOW. Retainers are typically billed on a monthly basis. Invoices are due upon receipt. Failure to meet investment obligations may result in a suspension of creative services. All payments are non-refundable as they represent dedicated studio time and resource allocation.

4. Confidentiality

Both parties agree to keep confidential all non-public information obtained from the other party during the course of the engagement. This includes brand strategies, partner data, performance metrics, and proprietary creative methods. This obligation shall survive the conclusion of our partnership.

5. Intellectual Property & Artistry

The partner retains all intellectual property rights to their pre-existing materials provided to Lone Peak Arts LLC. Any new creative content, designs, or campaign strategies engineered by Lone Peak Arts LLC specifically for the partner as part of paid services will become the property of the partner upon full payment. Lone Peak Arts LLC retains the right to use its general expertise, skills, and any non-partner-specific creative strategies developed during the engagement.

6. Limitation of Liability

Lone Peak Arts LLC will make every effort to achieve the partner's growth goals, but we do not guarantee specific market outcomes. The digital landscape is constantly shifting, and performance can be affected by external variables. In no event shall Lone Peak Arts LLC be liable for lost profits, or any indirect or consequential damages arising out of or in connection with our creative services.

7. Term and Dissolution

The term of the service agreement will be specified in the SOW. Either party may dissolve the agreement with a 30-day written notice. Upon dissolution, the partner is responsible for all fees incurred up to the date of termination. Lone Peak Arts LLC will cooperate in the transition of all account access and data back to the partner.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Lone Peak Arts LLC is registered, without regard to its conflict of law provisions.
